PLEASE READ THE FOLLOWING TERMS CAREFULLY. BY COMPLETING A PURCHASE OF A KIT FROM FULL SWING GOLF, INC. (“Full Swing” or “we”), YOU HEREBY AGREE TO BE BOUND BY AND ACCEPT THESE TERMS SET FORTH ON FULL SWING’S WEBSITE (the “Site”). THE FOLLOWING TERMS ARE SUBJECT TO CHANGE WITHOUT NOTICE; HOWEVER, THE TERMS THAT ARE CURRENT AT THE TIME OF YOUR PURCHASE WILL APPLY TO YOUR TRANSACTION.
U.S. SHIPPING POLICY – U.S.
The following terms constitute Full Swing’s KIT Shipping Policy for customers residing in the U.S.
Shipping Rates
At your selection, packages are shipped within the U.S. by way of either Ground (2-3 days) with a shipping fee of USD $25.00 or Expedited (overnight, in most cases) with a shipping fee of USD $50.00. Shipments to Alaska and Hawaii cannot be shipped via Ground transport. Shipping fees are nonrefundable.
Packages that are shipped to Mexico, by way of FedEx Express International Economy, will incur a shipping fee of USD $31.00 and to Mexico, by way of FedEx International, will incur a shipping fee of USD $26.00. Packages that are shipped to Canada, by way of FedEx Express International, will incur a shipping fee of USD $23.00 and to Canada, by way of FedEx Express Priority International, will incur a shipping fee of USD $26.00.
Unavailable Locations
At this time, orders cannot be shipped to PO Boxes, Army Post Office (APO), Fleet Post Office (FPO), or, except for business-to-business transactions, international addresses.
Shipment Processing Time
Orders placed online by individual consumers and received by Full Swing before 12:00pm PST on a Business Day (Monday thru Friday, excluding holidays recognized by the U.S.) will be shipped on the same date the order is placed. Orders placed by individual consumers online and received after 12:01pm PST on a Business Day will be shipped no later than close of business on the next Business Day.
Bulk business-to-business orders will ship by the close of business on the third Business Day after the order is received.
Please note, the delivery time is subject to the ability of our couriers. Full Swing is not responsible for delayed delivery.
Orders may be delayed from shipment due to discrepancies in billing or shipping information (i.e., missing or invalid apartment number) and/or conditions beyond the control of Full Swing, including, but not limited to, severe weather, fire, flood, accident, act of God, war, embargo, strike, material or supply shortages, transportation delays, epidemic, pandemic, diseases, or quarantine, or measures of any governmental authority, including as relevant to the aforementioned.
Shipping Confirmation & Tracking
Once your device has shipped, you will receive an email at the address provided at the time of your order containing the package’s tracking number. Upon delivery of the package at the designated address, the recipient must sign for the package; carrier rules will apply.
RETURN POLICY – U.S.
Full Swing stands by every product we sell, but, if necessary, we are here to make the return process as easy as possible. The following terms and conditions govern returns to Full Swing.
Return Eligibility
If you are not satisfied with your KIT within the first fourteen (14) days from the date of delivery, the KIT may be returned for a full refund or replacement device.
For users with a perpetual license for E6 Connect software used in conjunction with a KIT, if you are not satisfied with the E6 Connect software within the first fourteen (14) days from the date of activation of the perpetual license, the license may be returned for a full refund. This paragraph applies to users with a perpetual license only; all other subscription forms will not be eligible for refund.
If you are not satisfied with your KIT within the first twelve (12) months from the date of delivery, due to a defect, the KIT may be returned for replacement by way of a refurbished device or repair, and Full Swing reserves the right in its sole discretion to either repair or replace the unit.
All returns involving devices originally received outside of the U.S. shall be arranged through your local sales channel.
Returning Your Device
To initiate a return of your device, you must contact Technical Support at Full Swing by telephone at +1 (855) 688-1100 or email at [email protected]. The Technical Support team will provide you with a prepaid, shipping label and Return Material Authorization (RMA) number to send the device to Full Swing. Returns without a RMA number will not be accepted by Full Swing. The unit shall be returned with all accessories, including AC adapter and cables with travel case, and in the manufacturer’s original box.
Return Processing
Upon receipt of a returned device, the unit shall be inspected by Full Swing. If such inspection reveals that any of the warranty exclusions provided hereinafter apply, the warranty shall be voided and a repair fee assessed. If you wish for Full Swing to repair the device after having been advised that the warranty does not apply and you agree to pay the repair fees, fees will be charged to the credit card that was utilized to make the original purchase. For purchases made through Affirm, separate terms and conditions instituted by Affirm will apply; payment options through Affirm can be accessed at https://www.affirm.com/lenders.
LIMITED WARRANTY POLICY – U.S.
Full Swing extends the following Limited Warranty for the unit, which applies to your use of the device. This Limited Warranty applies to the defects set forth below that arise during the time period indicated, so long as the original purchaser or gifted recipient of the device remains in possession.
Warranty Period
Full Swing warrants against defects in materials, workmanship, and function of the unit for a period of twelve (12) months (or the minimum legal requirement in your local market) from the date of delivery (the “Limited Warranty”). During the warranty period, Full Swing will replace or repair your unit, in its sole discretion.
Warranty Exclusions
This Limited Warranty does not cover the following issues:
a. Damage or failure due to physical damage caused by drops or strikes, abuse, improper or abnormal use, improper maintenance, neglect, errors and omissions by anyone other than Full Swing, theft, fire, flood, or any act of God of any kind;
b. Damage due to non-Full Swing repairs or use of non-Full Swing approved accessories, including, but not limited to chargers or cables;
c. Damage due to unauthorized alterations or modifications;
d. Damage caused by liquid and/or liquid ingress, which may or may not be due to operating in a wet environment without a rubber Adapter Power Cover in place, or immersion or exposure to other liquids and chemicals;
e. Damage or failure due to normal wear and tear consistent with regular use, including, but not limited to, worn cables; or
f. Damage or failure due to power failures, power fluctuations, insufficient and inadequate heating, or electric shocks.
Warranty Process
To be eligible for service under this Limited Warranty, you must contact Technical Support at Full Swing by telephone at +1 (855) 688-1100 or email at [email protected]. The Technical Support team will provide you with a prepaid, shipping label and Return Material Authorization (RMA) number. No Returns will be received by Full Swing without a RMA. Upon Full Swing’s receipt of the device, the unit shall be inspected by Full Swing and repaired or replaced, at Full Swing’s sole discretion, with any combination of new, used, or factory refurbished parts.
General Terms
These terms will be governed by the laws of the State of California, without regard to conflicts of laws rules. Any disputes between you and Full Swing related to this purchase shall be determined by arbitration in San Diego County, California.
This Limited Warranty is the exclusive warranty given by Full Swing for this device and supersedes any prior, contrary, or additional representations. All other warranties, express or implied, including any statutory warranty or condition of merchantability or fitness for a particular purpose, are disclaimed, except to the extent prohibited by law. In such event, this Limited Warranty is limited to the duration of the warranty periods set forth above. This exclusion applies even if this Limited Warranty fails of its essential purposes and regardless of whether damages are sought for breach of warranty, breach of contract, negligence, or strict liability in tort or under any other legal theory.
RELEASE OF LIABILITY AND INDEMNIFICATION.
By purchasing product from Full Swing Golf, Inc.’s (“Company”) website, you (“Customer”) acknowledge and accept the responsibilities inherent in the purchase and use of Company’s Products, including golf and multi-sport Simulators, and related licensed software. To the extent permitted by law, Customer assumes all liability for claims of injury to person or property related to purchase or use of Simulator, and, except for gross negligence or material defects of products, agrees Company will not be liable to Customer for any loss, claim, or demand made by Customer or against Customer.
Customer expressly agrees for itself, its successors, assigns, representatives, employees, agents, clients, any user of the Simulator whether or not such use is authorized or permitted by Customer, and anyone else claiming by or through Customer or a user of the Simulator (each a “Releasor”) to release, discharge, and waive any and all claims, demands, or actions that a Releasor may have against Company, its affiliates, licensors, and contractors, and their respective directors, officers, employees, agents, or representatives (each a “Released Party”) arising out of or in any way related to Customer’s, or such Releasor’s, purchase or use of the Simulator (the “Released Claims”).
Customer further agrees, to the fullest extent allowed by law, to defend, indemnify, and hold harmless Company and any Released Party from and against all liability, loss, damage, or expense, related to the investigation, defense, and/or settlement of such claims, including court costs and reasonable attorney fees, arising out of or in connection with any such Released Claims. Customer shall have the authority to conduct the defense of and settle any action or proceeding related to a Released Claim; provided, however, that Customer shall not enter into any settlement affecting a Released Party without the prior written consent and approval of such Released Party. If Customer fails or refuses, for any reason, to assume the defense and indemnity obligations set forth in this Agreement, or to prosecute the defense of a Released Claim, Company and/or a Released Party shall have the right to assume and prosecute such defense with counsel of its own choosing, and Customer shall be liable for the full cost and expense of the defense and/or settlement of any such claim, demand, action, or proceeding. Company and/or Released Party shall have the right to use legal representation of its own selection and at its own expense to participate in Customer’s defense of a Released Claim, and/or independently resolve any such claim asserted against it. Customer acknowledges and fully understands and accepts the intent and consequence of the release, waiver, and hold harmless terms and provisions set forth herein.

Canada Terms

ORDERING, PRICES, AND PAYMENT – CANADA (EXCEPT FOR QUÉBEC)
Purchaser agrees to provide current, complete, and accurate purchase and payment information for all purchases made on the Site. Purchaser may place an order to purchase a product for sale on the Site by placing the product into Purchaser’s cart and following the onscreen prompts. Purchaser will have an opportunity to review and correct any input errors in the order until the order has been submitted. Payment can be made by most major credit or debit cards by completing the relevant details on the checkout page.
The prices of products advertised for sale on the Site are as set out on the Site. Prices may change at any time prior to, but not after, acceptance of an order. Full Swing is not responsible for pricing, typographical, or other errors in any offer by Full Swing and reserves the right to cancel any orders arising from such errors.
SHIPPING POLICY – CANADA (EXCEPT FOR QUÉBEC)
The following terms constitute Full Swing’s KIT Shipping Policy for purchasers residing in Canada, except for purchasers residing in the Province of Québec (the “Purchasers”).
Shipping Rates

Customer may be responsible for customs duties if such fees apply. Shipping fees and customs duties are nonrefundable.

Full Swing warrants that its products shall be free of defects in material, design, or workmanship for a period of twelve (12) months (or the minimum legal requirement of the Purchaser’s local market) from the date of delivery (the “Limited Warranty”). Subject to limitations and exclusions contained herein, should a defect in material or workmanship be discovered within such period, Full Swing’s sole obligation will be, at its option, to repair or replace the product pursuant to the terms of the Return Policy.

POLITIQUE D’EXPÉDITION – QUÉBEC
Les modalités suivantes constituent la politique d’expédition de trousses de Full Swing à l’intention des acheteurs qui résident dans la province de Québec (les « acheteurs »).
Frais d’expédition
Les colis expédiés au Canada par l’intermédiaire du service international FedEx Express feront l’objet de frais d’expédition de 23,00 $ US, et ceux expédiés au Canada par l’intermédiaire du service international FedEx Express Priority feront l’objet de frais d’expédition de 26,00 $ US. Le client pourrait devoir acquitter des droits de douane si de tels droits s’appliquent. Les frais d’expédition et les droits de douane ne sont pas remboursables.
Livraison non offerte pour certaines destinations
À l’heure actuelle, les commandes ne peuvent pas être expédiées à des cases postales ni à un bureau de poste des Forces canadiennes (BPFC), à un bureau de poste de la Flotte (BPF) ou, sauf dans le cas de transactions commerciales interentreprises, à des adresses internationales.
Délai de traitement des commandes
Les commandes passées en ligne par des acheteurs individuels et reçues par Full Swing avant 12 h (HNP) un jour ouvrable (du lundi au vendredi, à l’exclusion des jours fériés reconnus aux États-Unis) seront expédiées le jour même. Les commandes passées en ligne par des acheteurs individuels et reçues après 12 h 01 (HNP) un jour ouvrable seront expédiées au plus tard à la fermeture des bureaux le jour ouvrable suivant.
Les commandes interentreprises en gros seront expédiées au plus tard à la fermeture des bureaux le troisième jour ouvrable suivant la réception de la commande.
Veuillez noter que le moment de la livraison dépend de la capacité de nos services de messagerie.
L’expédition des commandes peut être retardée en raison d’erreurs dans les renseignements de facturation ou d’expédition (par exemple, si le numéro d’appartement est manquant ou non valide) et/ou de circonstances indépendantes du contrôle raisonnable de Full Swing, notamment des phénomènes météorologiques violents, un incendie, une inondation, un accident, un cas de force majeure, une guerre, un embargo, une grève, une pénurie de matériaux ou des problèmes d’approvisionnement, des retards dans le transport, une épidémie, une pandémie, des maladies ou une période de quarantaine ou des mesures prises par toute autorité gouvernementale, y compris à l’égard des éléments précités.
Confirmation d’expédition et suivi du colis
Les commandes livrées au Québec seront expédiées par l’intermédiaire du service postal des États-Unis. Une fois l’appareil expédié, un courriel indiquant le numéro de suivi du colis sera envoyé à l’acheteur à l’adresse fournie au moment de la commande. À la livraison du colis à l’adresse indiquée, le destinataire devra signer un accusé de réception; les règles du transporteur s’appliqueront et peuvent être consultées à l’adresse suivante : https://www.fedex.com/en-us/shipping/international-ground-canada.html.
GARANTIE LIMITÉE ET POLITIQUE DE RETOUR – QUÉBEC
Garantie limitée
Full Swing garantit que ses produits seront exempts de défauts matériel, de conception ou de fabrication pendant une période de douze (12) mois (ou la période légale minimale requise dans le marché où est situé l’acheteur) à compter de la date de livraison (la « garantie limitée »). Sous réserve des limitations et des exclusions contenues aux présentes, si un défaut de matériaux ou de fabrication est découvert pendant cette période, la seule obligation de Full Swing sera, à son gré, de réparer ou de remplacer le produit conformément aux modalités de la politique de retour.
Exclusions de garantie
La garantie limitée ne couvre pas les éléments suivants :
a. Les dommages ou les défaillances découlant de dommages matériels causés par des chutes ou des chocs, des abus, des accidents, une utilisation inappropriée ou anormale, un entretien inapproprié, de la négligence, des erreurs ou des omissions de la part de toute personne autre que Full Swing, un vol, un incendie, une inondation, ou un cas de force majeure de quelque type que ce soit;
b. Les dommages découlant de réparations effectuées par une personne autre que Full Swing ou de l’utilisation d’accessoires qui n’ont pas été approuvés par Full Swing, notamment des chargeurs ou des câbles;
c. Les dommages découlant de modifications non autorisées;
d. Les dommages causés par des liquides et/ou une infiltration de liquide, qui peuvent être attribuables ou non à l’utilisation de l’appareil dans un environnement humide sans avoir recours à un protecteur de bloc d’alimentation externe en caoutchouc (Adapter Power Cover), ou par l’immersion dans d’autres liquides et produits chimiques ou l’exposition à ceux-ci;
e. Les dommages ou les défaillances causés par l’usure normale dans le cadre d’une utilisation régulière, notamment l’usure des câbles;
f. Les dommages ou les défaillances découlant de pannes d’électricité, de fluctuations de courant, d’un chauffage insuffisant et inadéquat ou de chocs électriques.
Retour des appareils et/ou de logiciels sous licence perpétuelle
Full Swing sait que tous les produits qu’elle vend sont des produits de qualité; toutefois, si un retour doit être effectué, elle veillera à ce que le processus soit aussi simple que possible. Les modalités et conditions suivantes régissent les retours d’articles à Full Swing. Si, dans les quatorze (14) jours suivant la date de livraison d’une trousse, l’acheteur n’en est pas satisfait, il peut la retourner afin d’obtenir un remboursement complet ou un appareil de remplacement.
Pour les utilisateurs disposant d’une licence perpétuelle pour le logiciel E6 Connect utilisé conjointement avec un KIT, si vous n’êtes pas satisfait du logiciel E6 Connect dans les quatorze (14) premiers jours à compter de la date d’activation de la licence perpétuelle, la licence peut être retournée pour un remboursement complet. Full Swing n’acceptera pas les retours effectués sans numéro ARM. L’appareil doit être retourné avec tous ses accessoires, y compris le bloc d’alimentation externe, les câbles et l’étui de transport, dans la boîte originale du fabricant.
Full Swing inspectera tout article qui lui est retourné. PLEASE READ THE FOLLOWING TERMS CAREFULLY. BY COMPLETING A PURCHASE OF A KIT FROM FULL SWING GOLF, INC. (“Full Swing”), PURCHASERS HEREBY AGREE TO BE BOUND BY AND ACCEPT THESE TERMS SET FORTH ON FULL SWING’S WEBSITE (the “Site”). THE FOLLOWING TERMS ARE SUBJECT TO CHANGE WITHOUT NOTICE; HOWEVER, THE TERMS THAT ARE CURRENT AT THE TIME OF THE PURCHASE WILL APPLY TO THE TRANSACTION.
ORDERING, PRICES, AND PAYMENT – QUÉBEC
Purchaser agrees to provide current, complete, and accurate purchase and payment information for all purchases made on the Site. Purchaser may place an order to purchase a product for sale on the Site by placing the product into Purchaser’s cart and following the onscreen prompts. Purchaser will have an opportunity to review and correct any input errors in the order until the order has been submitted. Payment can be made by most major credit or debit cards by completing the relevant details on the checkout page.
The prices of products advertised for sale on the Site are as set out on the Site. Prices may change at any time prior to, but not after, acceptance of an order. Full Swing is not responsible for pricing, typographical, or other errors in any offer by Full Swing and reserves the right to cancel any orders arising from such errors.
SHIPPING POLICY – QUÉBEC
The following terms constitute Full Swing’s KIT Shipping Policy for purchasers residing in the Province of Québec (the “Purchasers”).
Shipping Rates
Packages that are shipped to Canada, by way of FedEx Express International, will incur a shipping fee of USD $23.00 and to Canada, by way of FedEx Express Priority International, will incur a shipping fee of USD $26.00. Customer may be responsible for customs duties if such fees apply. Shipping fees and customs duties are nonrefundable.
Unavailable Locations
At this time, orders cannot be shipped to PO Boxes, Canadian Forces Post Office (CFPO), Fleet Mail Office (FMO), or, except for business-to-business transactions, international addresses.
Shipment Processing Time
Orders placed online by individual Purchasers and received by Full Swing before 12:00pm PST on a Business Day (Monday thru Friday, excluding holidays recognized by the U.S.) will be shipped on the same date the order is placed. Orders placed by individual Purchasers online and received after 12:01pm PST on a Business Day will be shipped no later than close of business on the next Business Day.
Bulk business-to-business orders will ship by the close of business on the third Business Day after the order is received.

Orders may be delayed from shipment due to discrepancies in billing or shipping information (i.e., missing or invalid apartment number) and/or conditions beyond the reasonable control of Full Swing, including, but not limited to, severe weather, fire, flood, accident, act of God, war, embargo, strike, material or supply shortages, transportation delays, epidemic, pandemic, diseases, or quarantine, or measures of any governmental authority, including as relevant to the aforementioned.
Shipping Confirmation & Tracking
Orders delivered in Québec will be shipped through the United States Postal Service. Once the device has shipped, the Purchaser will receive an email at the address provided at the time of the order containing the package’s tracking number. Upon delivery of the package at the designated address, the recipient must sign for the package; carrier rules will apply and can be accessed at the following: https://www.fedex.com/en-us/shipping/international-ground-canada.html.
LIMITED WARRANTY AND RETURN POLICY – QUÉBEC
Limited Warranty
Full Swing warrants that its products shall be free of defects in material, design, or workmanship for a period of twelve (12) months (or the minimum legal requirement in the Purchaser’s local market) from the date of delivery (the “Limited Warranty”). Subject to limitations and exclusions contained herein, should a defect in material or workmanship be discovered within such period, Full Swing’s sole obligation will be, at its option, to repair or replace the product pursuant to the terms of the Return Policy.
Warranty Exclusions
This Limited Warranty does not cover the following issues:
a. Damage or failure due to physical damage caused by drops or strikes, abuse, accidents, improper or abnormal use, improper maintenance, neglect, errors and omissions by anyone other than Full Swing, theft, fire, flood, or any act of God of any kind;
b. Damage due to non-Full Swing repairs or use of non-Full Swing approved accessories, including, but not limited to chargers or cables;
c. Damage due to unauthorized alterations or modifications;
d. Damage caused by liquid and/or liquid ingress, which may or may not be due to operating in a wet environment without a rubber Adapter Power Cover in place, or immersion or exposure to other liquids and chemicals;
e. Damage or failure due to normal wear and tear consistent with regular use, including, but not limited to, worn cables; or
f. Damage or failure due to power failures, power fluctuations, insufficient and inadequate heating, or electric shocks.
Return of Devices and/or Software Perpetual License
Full Swing stands by every product we sell, but, if necessary, we are here to make the return process as easy as possible. The following terms and conditions govern returns to Full Swing.
If a Purchaser is not satisfied with the KIT within the first fourteen (14) days from the date of delivery, the KIT may be returned for a full refund or replacement device.
For users with a perpetual license for E6 Connect software used in conjunction with a KIT, if you are not satisfied with the E6 Connect software within the first fourteen (14) days from the date of activation of the perpetual license, the license may be returned for a full refund. This paragraph applies to users with a perpetual license only; all other subscription forms will not be eligible for refund.
If the Purchaser discovers that a device is defective within twelve (12) months from the date of delivery, the Purchaser may return the device to Full Swing for replacement by way of a refurbished device or repair. Full Swing reserves the right to repair or replace any device at its sole discretion.
Return Processing
To initiate a return of a device, the Purchaser must contact Technical Support at Full Swing by telephone at +1 (855) 688-1100 or email at [email protected]. (Full Swing’s mailing address is as follows: Full Swing Golf, Inc., ATTN: Technical Support, 1905 Aston Avenue, Suite 100, Carlsbad, California, 92008. However, initiation of a return should be directed to Technical Support only by telephone or email at the above details.) The Technical Support team will provide the Purchaser with a prepaid, shipping label and Return Material Authorization (RMA) number to send the device to Full Swing. Returns without a RMA number will not be accepted by Full Swing. The device must be returned with all accessories, including AC adapter and cables with travel case, and in the manufacturer’s original box.
Upon receipt of a return, the unit shall be inspected by Full Swing. If such inspection reveals that any of the warranty exclusions provided hereinafter apply, the warranty may be voided and a repair fee assessed. If the Purchaser wishes for Full Swing to repair the device after having been advised that the warranty does not apply and agrees to pay the repair fees, such fees will be charged to the credit card that was utilized to make the original purchase. If the Purchaser does not advise Full Swing of his or her consent to the repairs and the repair fees within fifteen (15) days after having been advised by Full Swing, Full Swing will have the right to return the device. For purchases made through Affirm, separate terms and conditions instituted by Affirm will apply; payment options through Affirm can be accessed at https://www.affirm.com/lenders.
All returns involving devices originally received outside of Canada shall be arranged through the Purchaser’s local sales channel.
General Terms
Not applicable to Québec consumers – These terms will be governed by the laws of the State of California, without regard to conflicts of laws rules.
Not applicable to Québec consumers – Any disputes between the Purchaser and Full Swing related to a purchase shall be determined by arbitration in San Diego County, California.
Not applicable to Québec consumers – This Limited Warranty is the exclusive warranty given by Full Swing for this device and supersedes any prior, contrary, or additional representations, warranties, or conditions. All other representations, warranties, and conditions, express or implied, including any statutory warranty or condition of merchantability or fitness for a particular purpose, are disclaimed, except to the extent prohibited by law. In such event, this Limited Warranty is limited to the duration of the warranty periods set forth above. This exclusion applies even if this Limited Warranty fails of its essential purposes and regardless of whether damages are sought for breach of warranty, breach of contract, negligence, or strict liability in tort or under any other legal theory.
